Terms of Service
Draft — pending legal review. These terms govern your use of Trip Tonic during the open beta.
1. Who we are
Trip Tonic is operated by Gian Andri Hofmann (“we”, “us”); contact details are in the privacy notice. By creating an account or using the service you agree to these terms.
2. The service
Trip Tonic is a collaborative trip-planning tool: you can create trips, build itineraries, chat with trip mates, track expenses, discover places, and use the AI assistant “Tonic” for suggestions.
3. Beta status
The service is provided as an open beta. Features may change, be removed, or malfunction; data loss cannot be ruled out. Please keep independent copies of information you cannot afford to lose. We may suspend or discontinue the beta at any time.
4. Your account
- You must be at least 16 years old to use Trip Tonic.
- Keep your credentials confidential; you are responsible for activity under your account.
- One account per person; provide accurate information.
- You can delete your account at any time from your profile page.
5. Your content
You retain all rights to the content you add (trips, messages, comments, images, expenses). You grant us the non-exclusive right to store, process, and display that content solely to operate the service — including showing it to the trip members you share a trip with. Don’t upload content you have no right to share.
6. Acceptable use
You agree not to:
- break the law or infringe others’ rights;
- harass or harm other users, or post unlawful or abusive content;
- probe, overload, scrape, or disrupt the service or circumvent its limits (including AI usage quotas);
- use the service to send spam or unsolicited invitations.
7. AI assistant
Tonic’s suggestions are generated by AI and can be inaccurate, incomplete, or outdated. They are not travel, legal, medical, or safety advice — verify important details (opening hours, prices, visa or health requirements) yourself before relying on them.
8. Third-party services
Maps, place details, and photos are provided by Google Maps; their use is additionally subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.
9. Availability & liability
The beta is provided free of charge and without any guarantee of availability. We are liable for damage caused intentionally or through gross negligence. To the extent permitted by law (Art. 100 of the Swiss Code of Obligations), any further liability, including for simple negligence, is excluded.
10. Termination
You may stop using the service and delete your account at any time. We may suspend or terminate accounts that violate these terms, with reasonable notice where feasible.
11. Changes to these terms
We may update these terms during the beta. We will announce material changes in the app; continued use after the announced date constitutes acceptance.
12. Governing law
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules of your country of residence remain unaffected.
